Sheeler Shelters LLC Rental Agreement

Introduction

When you rent a condo from Sheeler Shelters LLC directly rather than through a third-party website such as Airbnb or VRBO, we use this agreement to describe the relationship responsibilities.

  1. Properties
    Sheeler Shelters LLC properties includes the following fully-equipped condo:
    • Luana Kai Unit C106 at 940 S. Kihei Road, Kihei, HI 96753
      2 bedroom, 2 bath, 1,002 sq ft single level unit on the ground floor of Luana Kai Building C
    The invoice we send you (electronically or via conventional mail) indicates the property name and period for which it is being rented.
  2. Rental Period
    The invoice indicates the start and end dates of the rental period. Unless otherwise noted, the check-in time is no earlier than 4:00 PM (Hawaiian Time, of course) with check-out by 10:00 AM. We specify these times because we may have guests leaving and arriving on the same day and we need to prepare the unit between guests. It might be possible to make arrangements for an earlier check-in or a later check-out - please ask about this as soon as you know you might need it.
  3. Contact Information, Flight Information
    We request that you provide the following information:
    • Cell phone number (that you will have with you while in Hawai'i)
    • E-mail address
    • Postal address (if business is transacted over conventional mail)
    • Emergency and/or secondary contact name and phone number
    • Airline, flight number, and scheduled flight arrival time (if you are arriving on Maui the day that your rental starts) and the corresponding information for your departure flight (if you are leaving on Maui the day that your rental ends)

    We ask for this information to ensure we can be in contact with you and to know when you are likely to arrive at the condo.
  4. Guest Names, Responsibilities, and Limits
    We request the number of guests in your party and may request the names of all guests that will be staying in the unit. We request that all adult guests read and accept this agreement with the understanding that all guests are responsible if any guest violates a term of this agreement.

    Unit can accommodate up to six guests. The complex that this unit is limits occupants (guests and visitors) in those units at all times to no more than six people.
  5. House Rules
    Complete house rules for the condominium is posted on the Sheeler Shelters website. A summary of house rules is posted in the unit itself. While house rules are quite similar across Kihei, each complex has its own emphasis so we request that all adult guests acknowledge reading the summary version of the house rules. Nothing in those rules should be much of a surprise - you will be staying in a quiet, residential setting so you are expected and required to be respectful to others and their things and to act safely.

    Generally, the house rules:
    • Prohibit smoking (Hawai'i state law largely prohibits smoking in public areas.)
    • Require quiet hours from evening to early morning
    • Require special attention to safety in and around the pool area
    • Prohibit storing things (beach items) or hanging things (such as towels) on the lanai
    • Specify parking
  6. Occupancy and Usage
    Only the guests that are a party to this agreement are to occupy the property during the rental period. The property is for the quiet, residential use of the guests; as such, "parties" and "events" are inappropriate and not allowed.
  7. Care of the Property
    The cleaning fee covers light housecleaning - light floor and surface cleaning, bed sheet and towel laundering, light bathroom cleaning and the like - after your departure. We require that you leave the property in substantially the same condition that you found it in. Kitchen items (appliances, dishes, utensils) should be cleaned and put away. Excessive messes (floor dirt, counter spillage, the bathroom generally) should be cleaned before departure. Cleaning supplies can be found in the unit.
  8. Inspection
    The property is cleaned and inspected between guests. This is to ensure that the property condition meets our standard for incoming guests. As noted in a subsequent section, missing or damaged items identified during the inspection are the responsibility of the just-departed guest.
  9. Termination
    This agreement may be terminated and guests immediately removed if, soley at the discretion of Sheeler Shelters LLC, any guest violates the terms of this agreement during the rental period. House rule violations, actions that interfere with neighbors' quiet enjoyment during their stay at the associated resort, damage to unit, damage to unit contents, or damage to other parts of the associated resort violate the terms of this agreement may result in agreement termination.
  10. Invoiced Amounts
    The invoice for your rental period includes the rent for the unit itself, a cleaning fee, and Hawai'i taxes. The Sheeler Shelters website has an explanation of the taxes we are required to collect for Hawai'i.
  11. Deposit, Payment, Cancellation, Refunds
    When you book a rental directly with Sheeler Shelters, we have the following deposit, payment, and cancellation policies:
    • For bookings made six or more months before scheduled arrival, a deposit of one-third of the rental fee or US$ 400, whichever is greater, (plus GET on the deposit if you live in Hawai'i) is required to secure the booking.
    • For bookings made between six months and ninety days before scheduled arrival, a deposit of one-half of the rental fee or US$ 500, whichever is greater, (plus GET on the deposit if you live in Hawai'i) is required to secure the booking.
    • For bookings made within ninety days of scheduled arrival, payment of the full rental amount, cleaning fee, and taxes is required to secure the booking.
    • The deposit (or other payment) for a booking must be received by Sheeler Shelters LLC within seven days of the booking or the booking may be cancelled. Amounts beyond the required deposit may be paid to, for example, eliminate currency exchange risk.
    • Rental rates change often - with the season and based on demand and availability. After we receive your deposit, your rental rate is locked and guaranteed unless you cancel or change your booking.
    • Full payment of the rental amount, cleaning fee, and taxes is due sixty days before scheduled arrival.
    • A booking made more than sixty days in advance may be cancelled within seven days of booking for a full refund of the deposit.
    • A cancellation more than seven days after booking but more than sixty days before scheduled arrival forfeits half of the required deposit. In this case, any amounts paid beyond the required deposit will be refunded in full.
    • Failure to pay the full rental amount, cleaning fee, and taxes at least sixty days before the scheduled arrival will be considered an automatic cancellation and will result in forfeiture of the required deposit. In this case, too, any amounts paid beyond the required deposit will be refunded in full.
    • Cancellation less than 60 days before the scheduled arrival results in forfeiture of the minimum deposit and the remainder of the rental amount. We will refund the cleaning fee and the taxes. However, we will diligently attempt to re-rent the unit after we are informed of the cancellation. If we are able to re-rent the unit, we will refund 80% of the rental fee for that re-rental, up to your rental amount less the forfeited deposit. That partial refund of the rental amount, if any, will be made after the "new" guests arrive.
    • If you live in Hawai'i, GET applies to the forfeited amounts.
    • If, for reasons beyond our control, we are not able to provide the accommodations you booked, we will make the appropriate refund.
  12. Payment and Methods
    We produce and send (via e-mail) the rental invoice. The deposit, rental amounts, cleaning fee, and taxes can be paid with PayPal (payment to pay@SheelerShelters.com) or Venmo (smartphone app to @Jeffrey-Gilbert-18). Transactions fees are paid by the renter. (At the time of writing, PayPal charges about 3.5% for US payments and about 6% for Canadian payments. Venmo charge a 2% transaction fee and assesses a currency exchange fee of 3% - 5% for payment in non-US funds). There is no transaction fee for payment by check in US funds with a US bank routing code.

  13. Damage, Loss, and Security Deposit
    You are responsible for the repair or replacement of anything that you or your guest(s) damage or lose. This can be a problem with beach items (children are often not as careful at holding on to snorkeling equipment at they might be, for example). We want the guests after you to have the same opportunity to enjoy their time on Maui as you had.

    The unit has an inventory list of the items that are there for guest use - and that we expect will be there after you depart. (We do expect you to consume consumable items such as laundry soap, trash bags, and so on).

    We will clean the condo after your departure. However, you will be responsible for extraordinary expenses in this regard (for example,if the washer or dryer or bathtub/shower drain have to be serviced because of excessive sand or if a bathtub overflow caused damage).

    If you haven't stayed with us before then we may ask you for a refundable US$ 400 security deposit for any damage or loss. This deposit is to be made at the same time as the rental amount and cleaning fee is paid. We will refund your security deposit promptly - with a detailed list of any billings for damage or loss charged against it - immediately after the unit is serviced upon your departure. Of course, you are responsible for the full cost to rectify all damage and loss; your liability is not limited to the amount of the security deposit.

    Fortunately, we are happy to say, we haven't had many problems of this type but wanted to alert you to the topic.
  14. Electricity Surcharge
    We made bill guests for excessive electricity usage ("electricity surcharge"). The terms of the surcharge - along with an explanation and example - may be found here.
  15. Entry to the Unit During Your Stay
    If there is some reason to believe there is a health, safety, maintenance, or other substantial issue in the unit, we (or our agent) may enter the unit to investigate the issue. This may arise from a report by other residents at the complex or from complex employees. We will attempt to contact you first to resolve the issue but reserve the right to enter the unit if we can't get a timely resolution of the issue any other way.
